Fypbase | Upload Videos to TikTok

These Terms of Service ("Terms") govern your access to and use of the Fypbase application and website at www.fypbase.com (collectively, the "Service"), operated by Supersmart LLC ("Supersmart LLC", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Fypbase lets you create photo slideshows, add optional text, and send them as drafts to your own TikTok account using TikTok's official Content Posting API. The Service only acts on content you explicitly select and only when you initiate an action. Fypbase does not automatically post, schedule, or interact with any TikTok account on your behalf.

2. Eligibility and Accounts

You must be at least 13 years old (or the minimum age required by TikTok in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Connecting Your TikTok Account

To use the Service's core features, you authorize Fypbase to access your TikTok account through TikTok's secure OAuth flow. You grant us permission to use the access tokens issued by TikTok solely to perform the actions you request (such as sending a slideshow to your drafts) and to display your connected account information. You may revoke this access at any time by disconnecting your account in the app or from your TikTok settings.

4. Your Content and Responsibilities

You are solely responsible for the content you upload and publish through the Service. You agree that you will not use the Service to:

Upload content you do not own or have the right to use.
Post content that is unlawful, infringing, harmful, harassing, or otherwise objectionable.
Violate TikTok's Terms of Service, Community Guidelines, or Developer Policies.
Engage in spam, automation abuse, or any activity that misuses TikTok's API.

You retain all rights to the content you create. We do not claim ownership of your photos or captions; we only process them to provide the Service.

5. Compliance with TikTok

Your use of TikTok through the Service is also subject to TikTok's own Terms of Service and policies. The Service operates within TikTok's API limits and guidelines. We may suspend or limit functionality to remain compliant with TikTok's requirements.

6. Acceptable Use

You agree not to attempt to disrupt or compromise the Service, reverse engineer it, access it through unauthorized means, or use it to harm others. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

The Service, including its software, design, and branding, is the property of Supersmart LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will always be compatible with TikTok's API, which may change at any time.

9. Limitation of Liability

To the maximum extent permitted by law, Supersmart LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

10. Indemnification

You agree to indemnify and hold harmless Supersmart LLC and its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Upon termination, your data is handled as described in our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to Supersmart LLC, without regard to conflict-of-law principles.
